Terms

Billing Policy: Prior credit approval and current credit status are required for shipment on Open Accounts. Standard Open Account terms are net 30. Accounts not paid within terms are subject to credit hold and subject to interest charges of 1-1/2% per month. In the event legal action is necessary to enforce the terms of this agreement the prevailing party in such action shall be entitled to in addition to all other appropriate relief reasonable attorney's fees and costs as determined by the court.

Credit Policy:A completed and signed credit application is required to ship orders on Account. Orders may be shipped COD until such credit information has been received and approved.

Deliveries: Delivery to any common carrier fulfills the responsibility of the Seller. Seller shall not be liable for any damages caused by delay in delivery. Shipments are not insured beyond the point of delivery unless previously instructed. Every effort is made to ship all products within the time promised, but Seller is not liable for delays or defaults occasioned by strikes, differences with personnel, fires, accidents; delays or defaults occasioned by the exercise of government authority or in obtained materials or transportation, negligence of carriers, or by any cause beyond our controls. In the event of any delay in our performance due in whole or in part to any cause beyond our reasonable control, we shall have such additional time for our performance as may be reasonably necessary under the circumstances. All products made to customers specifications must be inspected and accepted before shipment is made, thereafter Shipper's responsibility ceases. Acceptance by you of any goods shall constitute a waiver by you of any claim for damages on account of any delay in delivery of such goods.

Freight and Shipping: Shipments will be made F.O.B. Shipping Point. Shipping and handling charges will apply with the exception of Will Call orders. Inbound Freight charges may be applicable on some Will Call orders. All claims for damages or loss will be immediately processed through the carrier.

Pricing: Prices contained in our catalog were current at the time of printing. Inflationary trends requires us to acknowledge that all pricing is subject to change without notice. Special conditions to contractors vary. All quoted prices supersede pricing in our catalog.

Acceptance of Orders: The Company reserves the right to refuse an order based on which contains gross error. Prices include the Company's standard packing of domestic shipment, where required. An extra charge will be made for special packaging or handling.

Shortage and Returns: All claims of shortage must be submitted to Plastic Services within 10 days of receipt. An RGA number (Return Goods Authorization) is required prior to the return of any goods. Our customer service representatives will provide the information needed to issue an RGA number. Items returned without a proper RGA number clearly marked on the outside of the shipping container will be refused and returned to the sender at his/her expense. Returned goods which are returned due to circumstances other than our error are subject to charges. Special order to custom items are not subject to return. By law returned items must be clear and free of any toxic substances. Any items returned for credit must be in original condition and are subject to inspection and count.

Cancellation: Plastic Services reserves the right to charge the customer for any costs incurred on canceled products deemed as "specially ordered fabrication".

Limited Warranty: Plastic Services makes no warranty or representation on any products provided. All products carry the original manufacturers warranty. Any defects incurred in shipment will be resolved by the carrier or shipper of the material.

Warranties: Warranties will be in accordance with that of applicable manufacturer of product in question. (Copies of warranties available on request).

Sales Tax: Sales tax will be charged according to law except when proper resale permit forms are completed and in our possession.

Tolerances and Variations: All goods shall be subject to tolerances and variations consistent with usual trade practices regarding dimensions, straightness, section, composition and mechanical properties and normal variations in surface and internal conditions and quality and shall also be subject to tolerances and variations consistent with practical testing and inspection methods.
